Real estate transactions in the Dominican Republic are governed by Law No. 108-05 Property Registration, effective April 4, 2007, and its implementing regulations. The ownership of a property is acquired by registration in the Register of Titles of a corresponding deed of sale, notary legalized that meets legal requirements. Once you sign the act, the Registrar of Titles issued for the purchaser a Certificate of Title checking his right of ownership over the property.
After obtaining the above-mentioned documents, the lawyer’s work is to ensure that the property contained in Certificate of Title be free from all third party rights and that is exactly the property you want to buy your client.
To this end, it must take the following steps:
• Research in the Registry of Deeds: Counsel shall be issued a certificate of title registry stating the status of the property.
